Terms and Conditions
These Terms and Conditions (“Terms of Use”, “Terms”) apply to the use of our Book My Surgery service (“Services”, “Service”, “Product”) which is made available to you by Mentor Health (“Mentor Health,” “we,” or “us”). By using our Book My Surgery service, you agree to these Terms of Use, as well as our Privacy Policy.
1. Description of the Service
Book My Surgery is a service provided by Mentor Health that offers patients a hassle-free experience when booking their surgeries. The app provides patients with an easy-to-use platform to book their surgeries in over 400 hospitals across 53 cities in Pakistan. The feature allows patients to choose from a list of hospitals, select the surgery they need, compare prices and facilities, and book their hospitalization and surgery according to their preferences with ease.
2. Eligibility
You must be 18 years of age or older to use our Book My Surgery service. By using our service, you represent and warrant that you are at least 18 years of age, and that you have the legal capacity to enter into this agreement. If you are using our service on behalf of any relatives, friends, company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms of Use.
3. Accuracy of Information
Users are responsible for providing accurate and up-to-date information. We are not responsible for any errors or inaccuracies in the information provided. If inaccurate or outdated information is provided, we reserve the right to cancel your surgery booking without notice. We are not responsible for any losses or damages that may result from inaccurate or incomplete information provided by you.
4. Estimation of Pricing and Negotiation Process
Please be aware that the price range indicated on our websites, app, or any printed material is provided as an estimate. The actual rates, including any relevant discounts, will be determined after our doctors conduct a thorough assessment of your medical history and engage in comprehensive case discussions. Through this process, our team will gather detailed information about your condition and specific needs, enabling us to negotiate more favorable arrangements with your chosen hospital.
5.Booking and Payment
When booking a surgery through our platform, you will be required to provide certain information, such as your name, contact information, and payment information. Payment for surgery bookings made through the Book My Surgery product must be made through the product’s secure payment gateway. We use a secure payment gateway to process your payment information, and we do not store any payment information on our servers. Any payments made outside of the secure payment gateway provided by us will not be covered by our payment protection policy, and we cannot guarantee the security or validity of such payments.
6. Cancellation and postponement
If you need to cancel your surgery, you must notify Mentor Health at least 72 hours before the scheduled surgery. We will process your refund after a small deduction. Please note that any cancellations or rescheduling of surgery bookings must be done in accordance with the policies of the surgeon and hospital. If you fail to inform us within the recommended time frame of 72 hours prior to surgery cancellation or postponement, we will not be responsible for any losses or damages incurred.
7. Liability
Mentor Health’s Book My Surgery service is solely a facilitation service and is not responsible for any medical treatment provided by the surgeon or hospital. We are not liable for any damages or losses resulting from the surgery or services provided by the hospital or surgeon. By using the Book My Surgery service, you release and hold harmless Mentor Health and its affiliates, directors, officers, employees, and agents from any and all claims, damages, and expenses, including attorneys’ fees, arising from or related to your use of the service or any medical treatment provided by the hospital or surgeon.
8. Intellectual Property
Mentor Health owns all rights, titles, and interests in and to the Book My Surgery service, including all intellectual property rights associated with the service. All content provided by the service is the property of Mentor Health and is protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or otherwise use any content from the service without our prior written consent.
9. Privacy
Mentor Health collects and uses personal information in accordance with its privacy policy. By using the product, you agree to the collection and use of your personal information as described in the privacy policy.
10. Modifications
Mentor Health reserves the right to modify these terms and conditions at any time without prior notice. Your continued use of the product after any modifications indicates your acceptance of the updated terms and conditions.
11. Governing Law
The Book My Surgery service provided by Mentor Health shall be governed by and construed in accordance with the laws of Pakistan. Any dispute arising from or related to the use of the service shall be subject to the exclusive jurisdiction of the courts in Pakistan.
12. Termination
Mentor Health reserves the right to terminate or suspend your access to the Book My Surgery service at any time, with or without cause, and with or without notice. In the event of termination, your right to access and use the service will immediately cease.
13. Disclaimer of Warranties
The Book My Surgery service is provided on an “as is” and “as available” basis, and Mentor Health makes no representations or warranties of any kind, express or implied, regarding the service or its use. Mentor Health does not warrant that the service will be uninterrupted or error-free, or that any defects will be corrected.
14. Indemnification
You agree to indemnify and hold harmless Mentor Health, its affiliates, officers, directors, employees, agents, and partners from and against any and all claims, liabilities, damages (actual and consequential), losses, and expenses (including attorneys’ fees) arising from or in any way related to your use of the service, including any breach by you of these terms and conditions.
15. Entire Agreement
These terms and conditions, together with any additional agreements or policies referenced herein, constitute the entire agreement between you and Mentor Health regarding the use of the Book My Surgery service and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Mentor Health.
16. Severability
If any provision of these terms and conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
17. No Waiver of Rights
The failure of Mentor Health to enforce any right or provision of these terms and conditions shall not be deemed a waiver of such right or provision.
18. Acknowledgment
By using the Book My Surgery service, you acknowledge that you have read these terms and conditions, understand them, and agree to be bound by them.
